GENERAL TERMS AND CONDITIONS FOR PURCHASING TICKETS ELECTRONICALLY
These General Terms and Conditions for purchasing tickets electronically (hereinafter referred to as the “General Terms and Conditions”) apply to all contracts for the purchase and sale of tickets concluded electronically via the website www.eventim.bg, which is operated and maintained by “Eventim.BG” OOD.
I. MAIN CHARACTERISTICS OF THE TICKETS SUBJECT TO SALE
Art.1. (1) The subject of the contracts for the purchase and sale concluded via the website www.eventim.bg are tickets for sports and entertainment events, conferences and other organized events (hereinafter referred to as the “events” or “the event”). (2) Basic information about each individual organized Event is published on the website www.eventim.bg, containing the name of the organizer of the Event, the performers, the date, time and venue of the Event, etc. (3) The tickets sold are essentially securities that entitle the person holding them to attend the respective event.
II. INDIVIDUALIZATION OF THE MERCHANT
Art.2. (1) The tickets are sold through the sales system of “EVENTIM.BG” OOD, a limited liability company, registered in the commercial register with the Registry Agency with UIC 131448006, with its registered office and registered office in Sofia, 58 6-ti septemvri Str., fl. 1 (hereinafter referred to as EVENTIM in the General Terms and Conditions). (2) When selling the tickets, EVENTIM acts on behalf of and for the account of the respective organizer of the event (see Part III below). (3) The address of the place where EVENTIM carries out its business activity coincides with the address of management specified in the above para. 1. EVENTIM is a commercial company registered under the Value Added Tax Act. (4) EVENTIM’s contact details are as follows: website www.eventim.bg, e-mail address info@eventim.bg, contact telephone number 02 / 961 53 70.
III. EVENT ORGANIZERS. INDIVIDUALIZATION OF THE PERSONS ON WHOSE BEHALF EVENTIM ACTS
Art.3. (1) Entertainment events for which tickets are sold electronically via the website www.eventim.bg are organized by third parties other than the ticket seller EVENTIM. These third parties, hereinafter referred to as the “Organizers”, have the obligation to provide ticket holders with access to the relevant event and are responsible for the timely conduct of the event and the promised quality of the entertainment service. (2) The Organizers determine the place and time of the event, the price of the tickets and all other characteristics and conditions under which the event will be held, including the conditions under which they will make any changes to the participants in festivals, including headliners, price changes, as well as changes related to the date, time and location of a given event and the manner of notifying customers of the changes that have occurred. (2) If the Organizer fails to fulfill its obligations in relation to a given event, including if the Organizer cancels the event, the latter is legally directly liable to the persons who purchased the tickets for their compensation and for the refund of the amounts paid (see Part IX. “Cancellation of an event. Refund of the paid price”). (3) The event organizer assigns EVENTIM the distribution and sale of tickets for the relevant event, and when selling tickets, EVENTIM acts on behalf and for the account of the relevant event organizer. (4) The name of the organizer of the relevant event and the seat and address of management of the latter are published on the website www.eventim.bg, in the description of the relevant event. The name of the organizer is printed on the event ticket.
IV. TICKET ORDER. PAYMENT METHOD. VOUCHERS
Art.4. (1) By placing a ticket order via the website www.eventim.bg, the customer makes a statement of concluding a contract for the purchase of a ticket electronically within the meaning of the Electronic Commerce Act. This statement is binding on the customer, and the order cannot be refused or changed. 2) To purchase a ticket via the website www.eventim.bg, customers must complete the following 8 steps: Step 1 – Select an Event or Performance Step 2 – Select Tickets Step 3 – Login / Registration Step 4 – Fill in the delivery address, if different from the home address. Steps 5 & 6 – Select payment and delivery method Step 7 – Review of the request – Confirmation Step 8 – Purchase (2) After successfully submitting the request, the customer receives an email from EVENTIM confirming receipt of the statement for concluding the contract for purchasing a ticket electronically. 3) A detailed description of each of the steps under para. 2 can be found by customers on the EVENTIM website, in the “Receive tickets by email” section. (4) The ordered tickets can be paid for by the customer by card. The card is charged in euros and there may be a difference in the payment amount due to differences in exchange rates. IMPORTANT REQUIREMENT: When paying for the ticket with a credit or debit card, the ticket must be received in person by the cardholder who made the payment. Otherwise, EVENTIM has the right to request additional documents and cancel the order if these documents are not provided.
(5) When a ticket order is placed by the customer, EVENTIM reserves the selected seats for the customer.
(6) When a ticket order is placed by the customer via the website www.eventim.bg, an order administration fee of EUR 1.02 is automatically charged for each purchased ticket, which the customers pay when purchasing the ticket. The specified fee serves and is intended to cover EVENTIM's costs related to the use, maintenance and updating of the electronic ticket sales system operated by EVENTIM, as well as human resource costs in the administration and servicing of online orders via this system.
(7) An invoice may be issued by the event organizer, and you must send a request to info@eventim.bg and you will be provided with the organizer's email address.
Art. 4a. (1) A voucher for a theater, concert, sports or cultural event can only be purchased via the EVENTIM website. (2) The voucher can be exchanged for a selected event from eventim.bg within one calendar year of its purchase only through the EVENTIM website. (3) An event voucher can be used under strict compliance with the following conditions: • A purchased voucher cannot be exchanged for its equivalent in BGN or change, in case the value of the selected tickets is lower than that of the voucher. • If the value of the tickets for a specific event exceeds the value of the purchased voucher, a mixed payment can be made by paying with a credit/debit card. In this case, two or more vouchers can be used to pay for the same order. • One voucher can be used to pay for different orders until its value is exhausted, • The voucher is valid until the expiration of a period of one year from the date of its purchase. • The voucher cannot be resold. • In the event of cancellation of the event for which the voucher was redeemed, the customer will be refunded the value of the ticket purchased using the voucher. • Violation of these terms of use makes the voucher invalid.
V. DELIVERY AND RECEIVING TICKETS
Art.5. (1) Delivery is paid by the customer. (2) Tickets paid by credit or debit card can also be collected on site at the EVENTIM head office, Sofia, 58 6-ti septemvri Str., 1st floor, working hours from 10:00 a.m. to 6:00 p.m., Monday to Friday, if this method of collection was selected during the purchase. (3) When using the “Receipt at EVENTIM head office” service, a fee of 1.30 euros is automatically charged, which customers pay when purchasing tickets. This is a system fee for using the service itself. It guarantees the seats you have purchased from the day of purchase until the day of the concert. When using the service "Receiving tickets from partner box offices in the EVENTIM network", a fee of 1.50 euros is automatically charged, which customers pay when purchasing tickets. Analogously to the service "Receiving at the EVENTIM head office", the fee for "Receiving tickets from partner box offices in the EVENTIM network" serves to guarantee the seats you have purchased from the day of purchase until the day of the concert. (4) When receiving tickets, the cardholder who paid for the tickets is obliged to verify his identity to EVENTIM employees by presenting an ID card.
VI. REQUIREMENTS FOR KEEPING AND SHOWING TICKETS. RULES FOR HOLDING EVENTS
Art.6. (1) Each visitor is obliged to keep his ticket until the end of the event. (2) When leaving the hall during an event, the return is only possible upon presentation of the ticket. No refunds will be given for tickets stolen, lost or damaged by the customer. (3) When purchasing a ticket, the visitor undertakes to comply with the internal rules established by the Organizer for the relevant event. Violation of the internal rules and misuse of the ticket may be punished with a warning to leave the hall. (4) EVENTIM warns that in general the internal rules of the organizers prohibit the use of sound recording devices, cameras and video cameras during events.
Minors and underage visitors to the Events
Art.7. (1) Pursuant to Art. 8, para. 3, 4 and 7 of the Child Protection Act and in connection with the provisions of the Regulation on Specialized Protection of Children in Public Places, minors and underage visitors to public places, including events held, must be accompanied by their parents, guardians, custodians or other adults who take care of the child, as follows: 1. persons under the age of 14 must be accompanied to events after 8:00 p.m.; 2. persons who have reached the age of 14 but have not reached the age of 18 must be accompanied to the events after 10:00 p.m. (2) When the minor or minor is accompanied by an adult other than their parent, guardian or custodian, the latter is obliged to present a declaration of consent for the child's presence at the event, issued in the name of the adult companion and containing notarized signatures of the parents, respectively the guardians or custodians. (3) Clients should keep in mind that individual Event Organizers may set specific restrictions regarding the age of admitted visitors. Due to the content of a particular production, a regulatory act may prohibit the admission of persons under a certain age. When purchasing tickets for minor visitors, the client is obliged to check in advance with the relevant Organizer whether minors and/or minor visitors are admitted to the event.
VII. CANCELLATION OF PURCHASED TICKETS
Art.8. (1) Pursuant to Art. 57, item 12 of the Consumer Protection Act, the provisions of Art. 50 - 56 on the consumer's right to withdraw from the distance contract within the 14-day cooling-off period shall not apply to the provision of services related to entertainment activities. In connection with the indicated legal basis, customers do not have the right to withdraw from tickets for entertainment events purchased electronically.
VIII. CANCELLATION OF AN EVENT. REFUND OF THE PRICE PAID
Art.9. (1) In the event of cancellation of an event, the Event Organizer shall be liable for the refund of the amounts paid for the tickets and for the compensation of the persons who have suffered damages due to the cancellation of the event. The cancellation of the event constitutes a failure by the Organizer to fulfill the obligation undertaken to provide the paid entertainment service. (3) The name of the Organizer of the relevant event and the seat and address of management of the latter are published on the website www.eventim.bg, in the description of the relevant event. The name of the Organizer is printed on the ticket for the event. (3) When selling tickets, EVENTIM acts on behalf and for the account of the relevant Organizer of the event. EVENTIM has no obligations regarding the organization of the events and their timely conduct and is not responsible for the quality of the entertainment service provided. (4) The price of the purchased tickets is refunded by EVENTIM only when the Organizer has assigned EVENTIM to carry out this refund on behalf and for the account of the Organizer itself and under the terms and conditions determined by the Organizer. (5) In case the Organizer has assigned EVENTIM to return on behalf of the Organizer the paid price of the tickets, the refund shall be made in accordance with the procedure and within the deadlines determined by the Organizer and announced on the EVENTIM website. In these cases, customers are refunded the amount printed on the front of the ticket, and the refund is made in the following ways: 1. Tickets purchased at an EVENTIM box office are returned to the place where they were purchased; 2. Tickets purchased through the website www.eventim.bg can be returned on site at the EVENTIM head office or remotely - by sending the ticket by courier to the EVENTIM management address, in which case the customer must provide EVENTIM with a bank account number to which the ticket price can be transferred. (6) In the event of the Organizer's refusal to refund the amounts paid for the tickets, customers may submit their requests for refund of the paid price directly to the Organizer at its management address, indicated in the event description, or file a complaint against the Organizer with the competent state authorities.
(7) In the case of tickets purchased online via the website www.eventim.bg, the following costs paid by end customers are not subject to refund: costs for the delivery of tickets through the use of courier services through an external provider (Art. 5, para. 2), fee for administrative service of the order (Art. 4, para. 7) and fees for using the services "Receipt of tickets from partner box offices in the EVENTIM network" and "Receipt of tickets from partner box offices in the EVENTIM network" (Art. 5, para. 5), since the indicated costs were charged for services that were already performed in connection with the purchase and delivery of the tickets and are independent of the specific organized event.
IX. CONSENT TO FILMING
Art.10. By accepting these General Terms and Conditions, customers express their consent to be filmed by all technical means during the broadcast of the event on television and to use the recordings made during or in connection with the event free of charge, without limitation of time and place.
X. PROTECTION OF PERSONAL DATA
Art.11. (1) EVENTIM, registered as a personal data controller within the meaning of the Personal Data Protection Act and in fulfillment of its legal obligations, takes the necessary technical and organizational measures to protect the data from accidental or unlawful destruction or accidental loss, from unauthorized access, modification or dissemination, as well as from other unlawful forms of processing. (2) By accepting these General Terms and Conditions, customers express their consent to EVENTIM collecting, processing and storing the personal data provided by them and using them for the purposes of fulfilling the concluded ticket purchase contracts.
XII. OUT-OF-COURT DISPUTE RESOLUTION
Art. 12. Users have access to out-of-court dispute resolution procedures with the assistance of alternative dispute resolution bodies. The general conciliation commissions are competent for disputes regarding tickets purchased online. (2) To facilitate access to online alternative dispute resolution, a link to the EU platform for online dispute resolution /titled "Online Dispute Resolution"/ is published on www.eventim.bg.
GENERAL PROVISIONS
Art. 13. (1) EVENTIM is not responsible for the validity and authenticity of tickets purchased at a location other than the EVENTIM website and box offices and partner box offices in the EVENTIM network. In this regard, EVENTIM advises its customers to purchase their tickets only from authorized box offices or via the website www.eventim.bg. Under no circumstances may customers be charged a higher price than the amount indicated on the front of the ticket. (2) EVENTIM warns that when holding concerts, due to the volume of sound, there is a risk of hearing or other health damage. The acceptance of these General Terms and Conditions by the customer makes them an integral part of the contract for the purchase of tickets electronically, which is concluded between EVENTIM and the customer by ordering tickets via the website www.eventim.bg.
